Welcome to ChatNasium ("Service", "Platform", "we", "us", "our"), operated by CareGuard Platform Technologies Corp. ("Company"). By accessing or using our AI-powered chat platform, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please discontinue use of our Service immediately.

ChatNasium is an artificial intelligence-powered conversational platform that provides:

• AI-generated responses to user queries across various topics
• Document analysis and file upload capabilities (for premium users)
• Voice input and output features
• Conversation history and management tools
• Access to specialized AI modes for different use cases
• AI-powered content and image generation for social media and external channels
• Itinerary creation with shareable links for external recipients

When you create an account with us, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach
• Not share your account with others or allow others to access your account
• Not create multiple accounts to circumvent usage limitations

You agree NOT to use the Service to:

• Generate, share, or request illegal, harmful, or abusive content
• Harass, threaten, impersonate, or harm others
• Spread misinformation, spam, or malicious content
• Attempt to reverse engineer, decompile, or extract the AI models
• Scrape, data mine, or systematically extract data from the Service
• Circumvent any security measures or access restrictions
• Violate any applicable laws, regulations, or third-party rights
• Use the Service for any commercial purpose without authorization
• Generate content that infringes on intellectual property rights
• Overload or interfere with the proper functioning of the Service

We offer multiple subscription tiers:

• Free: Limited daily questions, basic features
• Premium: Extended responses, file uploads, conversation history
• Premium Plus: Unlimited questions, advanced features
• Enterprise: White-label options, custom integrations

All subscriptions automatically renew unless cancelled. You may cancel at any time through your account settings. Refunds are provided according to our refund policy.

ChatNasium is committed to providing an unthrottled AI experience. Premium Plus subscribers are not subject to daily message limits, image generation caps, or upload throttling. Unlike other AI platforms that impose rate limits, waiting periods, or mid-session lockouts, ChatNasium does not throttle, rate-limit, or impose daily caps on Premium Plus subscribers. You will never see 'try again in 22 hours' or 'Max 0 uploads at a time' messages on a Premium Plus plan.

• Premium Plus: Unlimited AI chat messages with no daily caps
• Premium Plus: No image generation limits or waiting periods
• Premium Plus: No file upload throttling or lockouts
• Free Plan: Limited daily messages and uploads, but unthrottled — no waiting periods
• All plans: No mid-session rate limits or 'try again later' messages

We reserve the right to enforce fair use policies to prevent abuse, such as automated bot activity or systematic data extraction. Legitimate human use of the Service is never throttled or rate-limited on Premium Plus.

Your use of the Service is also governed by our Privacy Policy. We collect and use data as described in that policy. By using the Service, you consent to such data collection and use.

Our Service may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees of accuracy, completeness, or reliability of AI-generated content
• Uninterrupted or error-free operation of the Service
• Security of data transmission or storage

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAREGUARD PLATFORM TECHNOLOGIES CORP. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

You agree to indemnify, defend, and hold harmless CareGuard Platform Technologies Corp., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service immediately ceases. You may also terminate your account at any time through your account settings.

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CareGuard Platform Technologies Corp. regarding the Service and supersede all prior agreements and understandings.
